To James T. Gleaves Executor of the last will and testament of Randal Rutherford Deceased

Sir
This is to notify you that, I as one of the Heirs to the estate, of Randle Rutherford, Deceased Protest, against, your paying out any more of the monies belonging to said estate, except, the spescific Legesees named in the will, as I believe, that some persons are, presenting claims against said estate that are unjust and ought not to be paid, and shall not, be paid only by a due causes (course) of law

Transcriber Notes

 Hand-carried letter. William Rutherford lived in Polk County, Tennessee. John Austin, husband of Delilah Rutherford (born circa 1800), and Nancy (nee Rutherford) Orr lived in neighboring McMinn County. Randolph Rutherford died in Wythe County in January, 1841. He left a considerable estate to his widow and children in the form of specific bequests and in the distribution of the proceeds from the sale of his property. James T. Gleaves was executor of the Rutherford estate. It is clear from these letters that his children, scattered in Tennessee, Indiana, and Louisiana, squabbled over how and to whom this distribution would be made.
