Received of James T. Gleaves executor of Randle Rutherford Decd. Harry a negroe boy willed to me by the last will & Testament of the said Decd, And I do now bind myself my heirs & assigns to refund the said Harry or the amount of his appraisement to the Said executor his heirs or executor, provided the money arising from the sale of such property as was directed to be sold by the will of the said Decd, will not be sufficient to pay all just debts that may hereafter come against the estate of the said Randle Rutherford Decd, And if there should be a sufficiency of money to pay all just debts & expenses &c then the above obligation to be void else to remain in full force & virtue as witness my hand & seal this 14th day of February 1841

Randolph Rutherford died in January, 1841. He bequeathed a slave named Harry to his son, Nehemiah (1802 - ?). James T. Gleaves, executor of Rutherford's estate, had not yet sold the real and personal property belonging to the estate. This receipt is an acknowledgment by Nehemiah that he has taken possession of Harry from Gleaves on the condition that he will return Harry (or his equivalent in money) to the estate if the estate sale does not cover the estate debts. Harry escaped from Nehemiah in October 1841 (see Letter 1161) and was captured in November (see Letter 1164).
