An article of an agreement made and entered into on this 19th day of October in the year of our Lord 1831, Between Mary Phillippie wife to George Phillippie, Barbara Kisling wife to John Kisling by her representative Peter Kisling, Elizabeth Phillippie wife to Thomas Phillippie and Sally Spraker of the county of Wythe & State of Virginia of the one part, & Eve Spraker, Stephen Spraker & Daniel by his guardian William Henley, Eve Spraker & Daniel of the above named County & State & Stephen Spraker of the county of Decator & State of Indiana witnessth that the above Bound Eve Spraker, Stephen Spraker & Daniel Spraker doth agree to give up all claims to any personal property which may have been Devised to them by the last Will & Testmant of Jacob Spraker Decd. & have not been heretofore aspired of to the following persons, (to wit) George & Mary Phillippie, John & Barbara Kisling, Sally Spraker & Thomas Phillippie & Elizabeth Phillippie .

Accept that Eve Spraker will hold one sorral horse one cow and five hogs her choice, & Two feather Beds & Beadsteads & furniture, and one chest, and one flax wheel and such of her books as she may see cause to keep, and such of the pewter & Kitchen furniture as she may keep, and if there should be any of the property that has been withheld, by Eve Spraker remaining after the death of S'd. Eve Spraker it is agreeable to this article to go to the benefit of George Phillippie & wife & John Kisling & wife Thomas Phillippie & wife & Sally Spraker, and further we George Phillippie & Mary Phillippie John Kisling & Barbara Kisling. Thomas Phillippie & Elizabeth Phil[ip]pie & Sally Spraker Doth bind themselves to stand to the agreement herein made under the penalty of double of what each ones Share may be of the property that is the right of which is hereby relinquished by Eve Spraker to them.

It is further agreed By Stephen & Daniel Spraker to relinquish all further claims to any of the personal property that is now held on the plantation, Daniel Spraker By his guardian William Henley.

Transcriber Notes

Jacob Spraker wrote his Will on September 15. 1824 and it was probated on September 15, 1830. In the Will, he devised his land to his wife Eve (married 1791) and at her death to his sons, Peter, Christopher, George and Stephen. Daughters mentioned were Elizabeth, Sally, Mary and Barbara. Since Daniel has a guardian, he must be underage. In 1826, Barbara moved to Indiana which explains why she has a representative in this agreement.

It is unclear what caused the disagreement but it appears to be between the daughters on one side and their mother and her underage son and her son who had left the state on the other side.
